Separation court
A separation can be carried out without court and without a lawyer. However, each spouse is free to consult a lawyer. Each spouse is also free to have the separation ordered by the court.
For court proceedings, the granting of free legal aid and the appointment of a lawyer at court costs must be considered if the financial circumstances are tight. However, this only applies if the other spouse is not in a position to pay an advance on legal costs.
It is possible for each spouse to hire his or her own lawyer.
Often, only one lawyer is retained for cost reasons. In this case, however, it must be made clear from the outset whether the lawyer will represent the wife or the husband in the event of a conflict.
In mediation, a neutral expert (lawyer, other professions) supports the spouses in working out an amicable separation agreement.
